Japan’s AI Regulation Strategy Is the Opposite of Europe’s (And It Might Work Better)
While the EU is busy building a compliance fortress with the AI Act, Japan is doing something radically different. They’re betting that being the “most AI-friendly country in the world” is a better strategy than being the most regulated.
And honestly? I think they might be onto something.
The AI Promotion Act: Regulation Without the Stick
Japan passed its AI Promotion Act in September 2025, and if you’re used to reading about the EU AI Act’s €35 million fines, Japan’s approach will feel like a different planet.
There are no massive fines. No risk classification tiers. No mandatory compliance frameworks that require an army of lawyers to navigate.
Instead, Japan created an AI Strategy Headquarters — chaired by Prime Minister Sanae Takaichi herself — that coordinates policy across all government ministries. The focus is on guidelines, voluntary standards, and public-private collaboration.
Think of it this way: the EU says “here are the rules, follow them or pay.” Japan says “here are the goals, let’s figure out together how to get there.”

The Hiroshima approach emphasizes:
- Voluntary commitments over mandatory compliance
- Transparency and accountability through industry self-regulation
- Cross-border cooperation instead of unilateral regulation
- Risk-based approaches that don’t stifle innovation
This is “soft law” governance, and it’s a deliberate contrast to the EU’s “hard law” approach.
Why This Matters for AI Companies
If you’re building AI products, Japan’s approach creates a genuinely different market dynamic:
Lower compliance costs. You don’t need a dedicated compliance team to operate in Japan. The guidelines are clear, the expectations are reasonable, and the government actively wants to help you succeed.
Faster deployment. Without mandatory pre-market assessments for high-risk AI (like the EU requires), you can ship products faster in Japan.
Government as a customer. Japan’s government is actively buying AI solutions. The Government AI Gennai program is creating demand for AI products across every ministry.
But there’s a catch. Japan’s approach works because of cultural factors that don’t translate everywhere. Japanese companies tend to self-regulate more effectively. There’s a stronger sense of corporate responsibility. And the relationship between government and industry is more collaborative.
The Big Question: Which Approach Wins?
Here’s my honest take: both approaches have serious risks.
The EU risks over-regulating and pushing AI innovation to other regions. If compliance costs are too high, startups will simply build for markets that don’t require it. We’re already seeing European AI companies relocate to the US or UK.
Japan risks under-regulating and having to play catch-up if something goes wrong. Voluntary guidelines work great until they don’t. If a major AI incident happens in Japan, the lack of enforceable rules could become a political liability fast.
My bet? The winning approach will be somewhere in the middle. The EU will eventually loosen some requirements (they’ve already extended timelines). Japan will eventually add more enforcement mechanisms (the Personal Information Bill is a signal). And both will converge toward something that balances innovation with accountability.
But right now, in March 2026, if you’re an AI company choosing where to expand — Japan is making a very compelling case.
